Thank you for you interest in SSC Serv. This page contains the terms and conditions ("Terms and Conditions") for SSC Serv, the System Statistics Collection Service ("the software").

Obtaining SSC Serv

SSC Serv is provided on ssc-serv.com for customers to download. Customers will receive credentials for an account on ssc-serv.com, see Customer's account below. Using this account, you can download a binary installer package as often as required. If a copy on conventional media is required an additional shipping fee may be charged.
If you specified a postal address in the order form, a printed invoice will be sent to you.
Permission is granted to keep local copies of the installer package, for example on file servers or removable media, as long as the installer package is not made available to third parties.
For each license you may have one installation of SSC Serv. Licenses are not bound to a specific system, so you may remove the software from one system and install it on another system. However, you may not have more (running or runnable) installations of SSC Serv at any time than you bought licenses for.
Your purchased licenses of SSC Serv are valid without temporary restriction. This means you can continue using SSC Serv after your customer's account on ssc-serv.com has been closed, but you will not have access to new versions anymore.
We retain all right, title and interest in and to SSC Serv. The software is licensed, not sold, and all rights not expressly granted in this agreement are reserved.

Customer's account

After you ordered SSC Serv, a customer's account will be created for you. The credentials are sent to you via email and, if you specified a postal address, will be included in the printed invoice sent to you.
Your customer's account will be valid for one year, starting from the day the credentials were sent to you via email. After one year your account will either be closed or extended automatically for another year, depending on the option you chose when ordering SSC Serv. You will be sent an email reminder when your account on ssc-serv.com is about to be closed or extended automatically.

Privacy policy

Protecting our customer's privacy is very important to us. SSC Serv therefore does not communicate with any computer other than those specified by the user in the software itself.
Information entered when ordering the software is not used for any other purpose than processing your order of SSC Serv. The information is not given to any third party and your email address will only be used in the manner outlined above. To receive information about new versions please subscribe to the SSC Serv mailing list.

Disclaimer of Warranty

There is no warranty for the program, to the extent permitted by applicable law. Except when otherwise stated in writing the copyright holders provides the program "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the program is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction.

Limitation of Liability

In no event unless required by applicable law or agreed to in writing will the copyright holder be liable to you for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties or a failure of the program to operate with any other programs), even if the copyright holder has been advised of the possibility of such damages.
